What Changed in the 2023 I-9 Revision

The August 1, 2023 revision was the most significant redesign of Form I-9 in years. USCIS made these changes in response to employer feedback, COVID-era flexibilities, and the introduction of the DHS alternative procedure for remote verification.

Section 3 removed — replaced by Supplement B

The old Section 3 (Reverification and Rehires) was removed from the main form. All reverification and rehire documentation is now recorded on a separate Supplement B page. This allows employers to attach multiple Supplement B pages for employees with multiple reverification events.

Impact: Positive — eliminates the problem of running out of Section 3 space.

Supplement A introduced for preparers/translators

If a preparer or translator assists an employee with Section 1, they now complete a separate Supplement A page rather than a small certification box on the main form. This gives more space for multiple preparers.

Impact: Positive — cleaner documentation for complex situations.

Form shortened and reorganized

The main form was reduced from 3 pages to 2 pages. Many redundant instructions were removed and moved to the USCIS Handbook for Employers (M-274).

Impact: Positive — easier to complete and less paper to manage.

DHS alternative procedure added

For employers enrolled in E-Verify, a new checkbox was added to Section 2 to indicate that documents were examined using the DHS alternative procedure (remote video examination) rather than in-person. This is only available for E-Verify employers.

Impact: Major change — enables fully remote I-9 completion for E-Verify employers.

Citizenship/immigration status checkboxes clarified

The four immigration status attestation options in Section 1 were reworded for clarity, particularly the 'alien authorized to work' option which now more clearly explains what information must be provided.

Impact: Reduces Section 1 completion errors.

Common Confusion: Is There a New Form for 2026?

Every year, thousands of employers search for "I-9 form 2026" because they want to make sure they are using the most current version. This is a reasonable concern — using an outdated Form I-9 is itself a violation.

As of April 2026: No new form has been released. The 08/01/23 edition remains current. USCIS will announce any new version on their website and through official channels, and employers will typically have a 90-day transition period before the previous version becomes invalid.

E-Verify Integration Changes in 2023

The 2023 revision introduced the DHS alternative procedure, which is exclusively available to employers enrolled in E-Verify. Under this procedure:

This procedure can only be used for new hires made after the employer enrolled in E-Verify. It cannot be applied retroactively to existing employees' I-9s.

No. As of April 2026, the current Form I-9 has an edition date of 08/01/23 and is valid through May 31, 2027. USCIS has not announced a new version. Employers should continue using the 08/01/23 edition. If USCIS releases a new version, employers will typically have a 90-day transition period before the old version becomes invalid.

Where can I download the current Form I-9?

The official Form I-9 is available for free download directly from USCIS at uscis.gov/i-9. Do not use third-party versions of the form — only forms downloaded from the official USCIS website are valid. The current edition date (08/01/23) appears in the lower-left corner of the form.

What was changed in the 2023 Form I-9 revision?

The August 2023 revision made several significant changes: (1) Section 3 was removed from the main form and replaced with a separate Supplement B for reverification and rehire; (2) Supplement A was introduced for preparer and translator certifications; (3) the form was shortened and simplified; (4) the DHS alternative procedure for remote document verification was added for E-Verify employers; and (5) some fields were consolidated or reorganized.

Can I still use an older version of Form I-9?

For I-9s completed before the current version was required, the older forms remain valid for existing employees. However, for any new hire after the transition date (August 1, 2023), the current 08/01/23 edition must be used. You cannot retroactively apply the new form to existing employees — keep their original I-9s as completed.

When will the current Form I-9 expire?

The current Form I-9 (edition date 08/01/23) has an OMB expiration date of May 31, 2027. This is the date USCIS's Office of Management and Budget approval expires — it does not mean you need a new form before that date. USCIS typically releases a revised form before the expiration and provides employers a transition period. I9AuditReady will notify users when a new version is announced.
